The Congress on Tuesday (February 11) accused the Manipur Governor of violating Article 174(1) of the Constitution by failing to summon the state Assembly within the mandated timeframe.
As per the constitutional provision, there cannot be a gap of more than six months between two sessions of a state legislature.
Congress general secretary in charge of communications, Jairam Ramesh, pointed out that February 13 was the last day for a constitutionally required sitting of the Manipur Legislative Assembly.
In a post on X, he wrote, “Today is the last day for a constitutionally mandated sitting of the Manipur Legislative Assembly’s session. Article 174 (1) of the Constitution of India stipulates that there cannot be more than a 6 month gap between the last sitting of an assembly session and the first sitting of the next assembly session.”
Questioning the delay, he asked, “Why is the Manipur Governor violating Article 174(1) by not summoning the Manipur Legislative Assembly for its constitutionally mandated assembly session?”
Ramesh alleged that the session was rendered null and void because the BJP-led government failed to appoint a successor to Chief Minister N Biren Singh, against whom the Congress had planned to move a no-confidence motion.
“The session was declared null and void because the BJP could not appoint a successor to the CM against whom the Congress was scheduled to move a no-confidence motion yesterday and who was forced to resign on Sunday night,” he added.
Singh tendered his resignation late Sunday night to Governor Ajay Kumar Bhalla at Raj Bhavan in Imphal.
Speaking to news agency ANI, Ramesh expressed his dismay over what he described as a disregard for constitutional norms in Manipur.
“The Governor issued an ordnance making the resignation null and void. This is a violation of the Constitution. Even the SC said that the constitutional machinery in Manipur has collapsed,” he said.
Since the outbreak of ethnic violence in May 2023, over 250 people have been killed, and thousands have been displaced.
The Congress has persistently criticized the BJP government for its handling of the crisis and the prolonged instability in the state.
