The Congress on Sunday launched a sharp attack on the Bharatiya Janata Party (BJP) over controversial remarks made by two of its MPs against the judiciary, questioning whether the ruling party truly distanced itself from the comments and demanding concrete action.
Despite BJP president J.P. Nadda’s public disapproval of the statements, Congress leaders claimed his response amounted to little more than damage control.
Congress general secretary in charge of communications, Jairam Ramesh, dismissed Nadda’s rejection of the remarks as hollow.
“The distancing of the outgoing BJP President from the atrocious remarks made by 2 BJP MPs on the Chief Justice of India carries little meaning. These MPs are repeat offenders when it comes to hate speech and are very often used by G2 to attack communities, institutions, and individuals,” Ramesh posted on X.
He further alleged that the duo were routinely used by the BJP leadership—referred to as "G2"—to target communities, institutions, and individuals.
“This is Entire Political Science reflecting itself as Entire Political Hypocrisy,” he said, in a jibe referencing Prime Minister Modi’s past remarks about political science.
The controversy erupted after BJP MP Nishikant Dubey from Jharkhand, while speaking about recent incidents of violence in West Bengal and the Waqf Act, said that Chief Justice of India Sanjiv Khanna was responsible for “all civil wars in the country.”
Echoing anti-judiciary sentiment, BJP Rajya Sabha member Dinesh Sharma suggested that judicial intervention in legislative affairs defied the Constitution, asserting that “no one can challenge the President” after she assents to a bill passed by Parliament.
The criticism against the judiciary intensified following Vice President and Rajya Sabha Chairman Jagdeep Dhankhar’s recent comments on Article 142 of the Constitution, which allows the Supreme Court to issue orders to ensure “complete justice” in any pending case.
Dhankhar likened the article to a “nuclear missile” against democratic forces, adding that judges were assuming roles of the legislature and executive with “no accountability.”
His remarks drew widespread condemnation, with Congress MP Kapil Sibal saying that such statements from a Rajya Sabha Chairman were unprecedented and appeared to be aimed at “teaching the judiciary a lesson.”
Congress questioned the BJP’s silence over Dhankhar’s remarks, asking whether the party agreed with the Vice President’s views.
“The outgoing BJP President is totally silent on equally unacceptable remarks on the judiciary that are continually made by one of its very distinguished appointees to a high Constitutional position. What does he have to say about these remarks? Does the BJP subscribe to them?,” Ramesh asked. He further accused Prime Minister Narendra Modi of tacit support, citing his continued silence on the matter.
Congress MP K.C. Venugopal went a step further, calling the MPs’ comments contemptuous and urging the Speaker and judiciary to take action.
“It is a clear case of contempt of court, violation of Constitution. This cannot be taken lightly. A serious allegation has been made by a member of Parliament against the Chief Justice of India. It is a serious direct attack on the judiciary. The Speaker and the Court should take action. They are trying to threaten the judiciary. This is the most dangerous action against democracy,” Venogopal told ANI.
Responding to the furore, BJP president J.P. Nadda said that the remarks made by the MPs were their personal opinions and did not reflect the BJP’s position.
“The BJP has nothing to do with the comments of MPs Nishikant Dubey and Dinesh Sharma on the judiciary and the Chief Justice of India. This is their personal comments, but the BJP neither agrees with them nor does it ever support such remarks. The BJP absolutely rejects them,” Nadda said in a post on X.
However, Congress has remained unconvinced, reiterating its demand for disciplinary measures against the MPs and questioning the BJP's internal accountability.
