INDIA Bloc Plans Impeachment Motion Against CEC Gyanesh Kumar

The opposition INDIA bloc is set to move an impeachment motion against Chief Election Commissioner (CEC) Gyanesh Kumar, The Wire reported, citing sources.

Under the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, the CEC can only be removed in the same manner as a Supreme Court judge.

As per the Judges Inquiry Act, 1968, an impeachment motion against a Supreme Court judge can be initiated if at least 100 members of the Lok Sabha or 50 members of the Rajya Sabha sign the notice. The Speaker of the Lok Sabha or the Chairman of the Rajya Sabha then has the discretion to admit or reject the motion.

The INDIA bloc’s decision followed a meeting of its MPs on August 18. The move comes a day after the Election Commission held a press conference addressing allegations of “vote theft” during the electoral process.

In the briefing, the Commission accused some political parties of “creating confusion among voters” regarding the ongoing special intensive revision (SIR) of electoral rolls in Bihar.

At the same press conference, CEC Gyanesh Kumar issued an ultimatum to Leader of Opposition Rahul Gandhi, asking him to either apologise or submit an affidavit within seven days supporting his allegation that over one lakh votes were stolen in the Mahadevpura constituency of Karnataka during the 2024 Lok Sabha polls.

Kumar, however, did not explain why similar demands were not made of BJP MP Anurag Thakur, who had alleged irregularities in voter lists in Wayanad, Rae Bareli, Kannauj and Diamond Harbour.

The Commission also failed to clarify how many enumeration forms with proper documents were received in Bihar’s SIR or how many so-called “illegal immigrants” were identified in the exercise.
