5,297 PMLA Cases Registered Since 2014, Only 40 Convictions: MoS Home Tells Lok Sabha

Since 2014, a total of 5,297 cases have been filed under the Prevention of Money Laundering Act (PMLA), with a noticeable increase in cases following key amendments made in 2019 that intensified the law's provisions.

MoS Home Nityanand Rai on Tuesday (August 6), provided data in a written reply to a question by the All India Majlis-e-Ittehadul Muslimeen (AIMIM) MP Asaduddin Owaisi in the Lok Sabha, news website The Wire reported.

The data, sourced from the Enforcement Directorate (ED), covers cases registered under PMLA from 2014 to 2024. 

According to the data, from 2014 to 2024, a total of 5,297 cases have been registered under the PMLA, but only 40 cases have resulted in convictions, while 3 have ended in acquittals.

The PMLA was enacted in 2002 by the then Bharatiya Janta Party (BJP) government to address black money linked to international drug trafficking. However, amendments to the law in 2012 under the UPA government and in 2019 under the Modi government have substantially expanded its scope. The number of scheduled offenses has increased from the original 40 offenses under six laws to 140 offenses under 30 laws.

Quoting government data, The Wire reported that in 2019, 188 cases were registered under the PMLA. This number increased to 708 in 2020, 1,166 in 2021, 1,074 in 2022, 934 in 2023, and 397 in 2024.

In comparison, the number of cases registered was significantly lower in previous years: 195 cases in 2014, 148 in 2015, 170 in 2016, and 146 in 2017.

The data also revealed a significant increase in the number of accused currently under arrest under the PMLA from 2016 to 2024, with a notable rise starting in 2021. The number of accused under arrest rose from 31 in 2021 to 53 in 2022, 139 in 2023, and 140 in 2024.

Among states, Delhi has the highest number of accused currently under arrest. The count increased from 8 in 2021 to 12 in 2022, 32 in 2023, and 36 in 2024.

Jharkhand has also experienced an increase in the number of accused under arrest. The count rose from 3 in 2021 to 7 in 2022, 22 in 2023, and 18 in 2024, the news website reported.

In the same reply, Nityanand Rai provided data on cases registered under the Unlawful Activities Prevention Act (UAPA) from 2014 to 2024. The data indicates that a total of 8,719 cases have been registered under the UAPA, with 567 acquittals and 222 convictions.
