The Delhi Police on Wednesday (March 6) opposed a petition seeking an FIR against BJP leader and current Delhi Law Minister Kapil Mishra for his alleged role in the 2020 Northeast Delhi riots.

The plea, filed by Yamuna Vihar resident Mohammad Ilyas, sought an investigation into Mishra and six others, but the police maintained that his involvement had already been probed, and no incriminating evidence was found.

The case was heard by Additional Chief Judicial Magistrate Vaibhav Chaurasia, who is set to deliver his decision on March 24.

Ilyas, in his petition filed in December 2024, alleged that Mishra, along with Mustafabad MLA and Deputy Speaker Mohan Singh Bisht, former North East DCP, the then SHO of Dayalpur police station, and former BJP legislator Jagdish Pradhan, played a role in the communal violence that left 53 people dead and over 700 injured, The Hindu reported.

According to Ilyas, on February 23, 2020, he witnessed Mishra and his associates blocking a road in Kardampuri and damaging street vendors’ handcarts.

He also alleged that Mishra, in the presence of senior police officials, threatened anti-CAA protestors. Additionally, the petition accused former officers of vandalizing mosques in Northeast Delhi during the riots.

While Delhi Police have charged several student leaders and activists—including Umar Khalid, Gulfisha Fatima, and Sharjeel Imam—as co-conspirators in the riots, a fact-finding report by the Delhi Minorities Commission pointed to a different narrative.

The commission's 10-member team found that the violence was "planned and targeted" and held Mishra accountable.

The report specifically highlighted Mishra’s speech at Maujpur on February 23, 2020, where he allegedly incited violence by demanding the removal of anti-CAA protestors from Jafrabad.

"But after that we will not listen to the police if roads are not cleared after three days," Mishra reportedly declared, while standing next to then-DCP Ved Prakash Surya.

The fact-finding team criticized the police for failing to act against Mishra, stating that their inaction allowed the violence to escalate.

The case remains under judicial scrutiny, with the next hearing scheduled for March 24.
