The Supreme Court on Wednesday (August 14) stated that it is unable to grant immediate interim bail to Delhi chief minister Arvind Kejriwal, who is seeking release from jail in connection with a corruption case filed by the Central Bureau of Investigation (CBI) concerning alleged Delhi Liquor Policy scam.
The bench of Justices Surya Kant and Ujjal Bhuyan also issued a notice regarding a separate petition filed by Kejriwal, which challenges his arrest by the CBI. The cases are scheduled to be heard again on August 23.
"We are not granting any interim bail. We will issue notice," the bench told senior advocate Abhishek Singhvi, who was appearing for Kejriwal, news agency PTI reported.
Singhvi argued that Kejriwal had been granted interim bail on three occasions in the money laundering case, despite the strict requirements of Section 45 of the Prevention of Money Laundering Act (PMLA). He referred to interim bail orders issued by the Supreme Court on May 10 and July 12, as well as a regular bail granted by the trial court on June 20. Singhvi noted that the June 20 order was stayed by the Delhi high court following an "oral mention."
When Singhvi highlighted that Kejriwal had also requested interim bail, Justice Kant responded, "We are not granting any interim bail," Live Law reported.
The Aam Aadmi Party (AAP) chief approached the Supreme Court after the Delhi high court rejected his challenge to the CBI arrest. He has previously been granted bail by the Supreme Court in a separate case related to the Enforcement Directorate (ED) and the alleged liquor policy scam.
Kejriwal has been in custody since March 21 following his arrest by the ED, except for a 21-day interim bail granted by the Supreme Court in May for Lok Sabha election campaigning.
The case against the chief minister arises from allegations of irregularities in Delhi’s now-abandoned excise policy for 2021-22. The CBI initiated its investigation after a recommendation from Delhi’s lieutenant governor in July 2022.
