The Supreme Court on Tuesday (April 22) agreed to list a plea seeking the removal of social media posts and videos containing controversial remarks made by BJP MP Nishikant Dubey against Chief Justice of India (CJI) Sanjiv Khanna. The petition, brought before a bench led by Justice B.R. Gavai, is expected to be heard next week.

During the hearing, advocate Narendra Mishra, representing the petitioner, told the court that Dubey's comments—alleging that the CJI was responsible for "all civil wars in the country" and the Supreme Court for "religious wars"—had gone viral and sparked an online barrage of derogatory language targeting the judiciary.

He urged the court to direct social media platforms to take down the offensive content, noting that representations to the Attorney General (AG) and Solicitor General had thus far yielded no action.

Please give direction to social media to remove videos,” Mishra said, expressing concern over the government’s inaction, reported Live Law.

The comments, made by Dubey over the weekend amid a broader standoff between the executive and the judiciary—exacerbated by Vice President Jagdeep Dhankhar’s recent criticism of the Supreme Court—have triggered sharp condemnation from legal circles.

The Supreme Court Bar Association (SCBA) on Tuesday issued a statement denouncing Dubey’s remarks as "defamatory" and "contemptuous." It described the statements as a direct attack on the dignity of the Chief Justice and the institution of the judiciary itself.

“This attack on the Supreme Court as an institution and qua the Chief Justice of India Mr Justice Sanjiv Khanna as an individual is unacceptable and must be dealt with in accordance with law,” the SCBA stated, expressing hope that the AG would soon grant consent to initiate contempt proceedings.

Separately, advocate-on-record Anas Tanwir has written to Attorney General R. Venkataramani seeking his sanction to begin contempt proceedings against the four-time BJP MP.

In his letter, Tanwir termed Dubey’s comments “grossly scandalous” and accused him of attempting to undermine public confidence in the judiciary.

Despite growing calls for accountability, BJP president and Union minister J.P. Nadda distanced the party from Dubey’s statements, stating that the party "has nothing to do" with the remarks. However, Nadda did not clarify whether disciplinary action would be taken against the MP.

As of now, the Attorney General is yet to respond to Tanwir’s letter.
