The Allahabad High Court on Friday (May 29) sought a response from the Uttar Pradesh government on a habeas corpus petition filed on behalf of journalist Satyam Verma, who was arrested in April following labour unrest and violence in Noida.

The petition was moved through his wife, Shakambhari, challenging the legality of his arrest and continued detention.

A division bench comprising Justice Salil Kumar Rai and Justice Devendra Singh-I issued notice to the state authorities and granted them time to submit a counter affidavit detailing their position in the matter.

Verma was represented by senior advocate Syed Farman Ahmad Naqvi, assisted by advocates Shashwat Anand, Ankur Azad and Shashank Tiwari.

According to a press note issued by Verma’s legal team, his habeas corpus petition challenges the legality of his arrest, detention and continuing custody in the criminal cases lodged against him after last month’s labour unrest and violence in Noida, The Wire reported.

“It raises questions concerning compliance with constitutional safeguards governing arrest and personal liberty, as well as the validity of the subsequent custody and remand proceedings,” it said.

The legal team further stated that the case touches upon important issues relating to individual liberty and the exercise of state powers.

The press note further stated that following the high court’s directive, the outcome of the proceedings is likely to be closely watched by the legal fraternity, civil liberties advocates and media organisations, given the intersection of preventive detention powers and constitutional protections.

The petition filed by Shakambhari challenges not only Verma’s arrest but also the subsequent detention and remand proceedings.

It alleges serious procedural irregularities in the manner of his arrest and custodial transfer and seeks his release, along with directions for preserving electronic and documentary evidence related to the detention.

Verma was arrested in Lucknow on April 17 and has remained in custody since then. The matter is expected to come up again after the state files its response before the court.
