The Calcutta High Court has ordered a Central Bureau of Investigation (CBI) investigation into the alleged rape and murder of a 31-year-old junior doctor, who was found dead in a seminar hall at RG Kar Medical College and Hospital in Kolkata on Friday.
A division bench of Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya was hearing several pleas, including one from the victim's parents requesting the transfer of the investigation to an independent agency, Live Law reported.
Expressing concerns over the progress of the investigation by the state police, the bench held: “The administration was not with the victim or her family. The principal has not even given a statement. Without significant progress in the investigation, we would be well justified in accepting the prayers by the victim's parents that evidence would be destroyed. Therefore, we transfer the investigation to the CBI to do justice between parties and to inspire public confidence.”
The court has directed the police to transfer all documents related to the case to the CBI by 10 a.m. on Wednesday. Additionally, it has urged the protesting doctors to end their strike, emphasizing their "pious obligation."
The National Human Rights Commission of India has also taken suo motu cognizance of the case, noting the death's mysterious circumstances.
On August 9, the deceased, a postgraduate trainee in the chest medicine department, was found dead in the seminar hall of the hospital's Emergency building. Following the incident, junior doctors, interns, and postgraduate trainees at all government-run hospitals in the state are on a continued strike, demanding justice for the victim and improved safety measures at their institutions.
Doctors across several hospitals in India too have called for an indefinite strike to protest the brutal rape and murder of a trainee doctor. Medical professionals in Delhi, Mumbai, Kolkata, and other cities have announced that all elective services will be suspended until the investigation into the case is concluded.
On Monday, state chief minister Mamata Banerjee visited the victim's family and promised justice. She announced that the case would be transferred to the Central Bureau of Investigation (CBI) if the police did not resolve it by Sunday.
