The Delhi High Court has permitted incarcerated Jammu and Kashmir MP Sheikh Abdul Rashid, better known as Engineer Rashid to attend the second part of the ongoing Parliamentary session from March 26 to April 4, under police custody.
A division bench of Justice Chandra Dhari Singh and Justice Anup Jairam Bhambhani on Wednesday (March 26), directed the Director General (Prisons) to facilitate Rashid’s travel from prison to Parliament House under a police escort during Lok Sabha session hours, Live Law reported.
Strict Conditions Imposed
The court specified that upon reaching Parliament, Baramulla constituency MP will be handed over to the Parliament security/marshals, who will oversee his movements within the premises.
“At the Parliament House, the appellant shall be handed-over to the custody of Parliament security/marshals, who shall allow the appellant to attend the proceedings of the Lok Sabha and to avail other facilities and amenities within the Parliament House during the hours that the Lok Sabha is in session; and shall thereafter hand-back custody of the appellant to the prison escort, who will bring him back to prison straight from the Parliament House, on the same day, without any delay,” the Court said, reported Live Law.
While outside the jail premises, Rashid will not be allowed to use a phone, access the internet, or speak to the media, the court ordered.
Additionally, he is barred from interacting with anyone except in the Lok Sabha House, and only in relation to his parliamentary duties.
The High Court further stated that Rashid must bear the costs of his travel and other necessary arrangements.
During the hearing, Rashid’s counsel, Senior Advocate N Hariharan, clarified that his client was not seeking interim bail or custody parole but only permission to participate in the Parliamentary session while in custody.
The High Court’s decision ensures Rashid’s participation in the legislative process while maintaining strict supervision.
Rashid, an independent MP from Jammu and Kashmir, has been in custody in connection with a case under investigation.
