A Delhi sessions court on Wednesday (April 9) stayed a lower court order that had directed the police to investigate Delhi Law Minister Kapil Mishra’s alleged role in the 2020 North-east Delhi riots.
The stay was issued by Additional Sessions Judge (ASJ) Kaveri Baweja of the Rouse Avenue Courts, who passed the order while hearing a revision petition filed by the Delhi Police challenging the trial court’s directive.
“Let notice of the revision petition be issued to the respondents returnable on 21.04.2025. The record of the court of Ld. ACJM be also requisitioned for the next date fixed. In the meantime, the operation of the impugned order shall remain stayed till the next date of hearing,” the judge stated, reported Bar and Bench.
The trial court order, passed on April 1 by Additional Chief Judicial Magistrate (ACJM) Vaibhav Chaurasiya, had found that a cognizable offence was made out against Mishra and directed further investigation.
The direction was based on a complaint filed by Mohammad Ilyas, a resident of Yamuna Vihar, who had sought an FIR against Mishra for his alleged role in inciting the riots. The complaint also named the then SHO of Dayalpur police station and five others.
In response, the Delhi Police argued that Mishra had already been investigated and no incriminating evidence was found. A separate revision petition filed by Mishra also led to a similar stay on the probe.
The matter is now slated for the next hearing on April 21.
