A letter has been submitted to the Attorney General for India, R Venkataramani, seeking sanction to initiate criminal contempt proceedings against BJP MP Nishikant Dubey for his remarks targeting the Supreme Court and Chief Justice of India, Justice Sanjiv Khanna.
The request was made under Section 15(1)(b) of the Contempt of Courts Act by an Advocate-on-Record (AoR), who alleged that Dubey’s statements amounted to a grave attack on the judiciary’s integrity and independence, Live Law reported.
According to the letter, Dubey alleged that the "Supreme Court is taking the country towards anarchy" and claimed that "Chief Justice of India Sanjiv Khanna is responsible for the civil wars taking place in the country." These comments were reportedly made in reaction to the Supreme Court directing constitutional authorities like the President and Governors to act within a specific timeframe on pending Bills.
The AoR also alleged that Dubey made communally charged remarks in the context of the Supreme Court's intervention in petitions challenging the Waqf Amendment Act.
The letter described Dubey’s statements as "deeply derogatory" and "dangerously provocative," accusing him of attempting to incite public dissent and unrest by "recklessly attributing national turmoil" to the Chief Justice. It further stated that the MP’s comments, made without any legal or factual basis, were aimed at scandalising the highest judicial office in the country and undermining public confidence in the judiciary.
"He recklessly attributes national unrest to the Hon'ble Chief Justice of India, thus scandalising the highest judicial office in the country and attempting to provoke public dissent, outrage and possible unrest," the letter said, reported Live Law.
The letter called for criminal contempt proceedings to be initiated for what it termed a deliberate attempt to vilify the court.
In the wake of growing controversy over Dubey's remarks, BJP National President JP Nadda distanced the party from the comments, clarifying that they were the MP’s personal opinions and did not reflect the party’s official stance.
