The Central Bureau of Investigation (CBI) on Thursday (August 22) informed the Supreme Court that there seemed to be an effort to conceal the facts related to the rape and murder of a post-graduate medical student at Kolkata's RG Kar Medical College and Hospital.

The CBI alleged that the local police had tampered with the crime scene before the central agency assumed control of the investigation.

A bench of Chief Justice of India (CJI) DY Chandrachud with Justices JB Pardiwala and Manoj Misra is currently hearing a suo motu case related to the R G Kar hospital rape and murder incident.

Representing the CBI in court, Solicitor General Tushar Mehta informed the bench that both senior doctors at the hospital and the victim's colleagues had requested videography of the crime scene. Mehta claimed that these requests indicated that they suspecting an attempt to cover up the incident, news agency PTI reported.

"We entered the probe on the fifth day. Before that, whatever was collected by the local police was given to us. The investigation itself was a challenge because the scene of offence was altered. The FIR was registered only after the (victim's) cremation at 11:45 pm. First, the parents of the victim were informed by the deputy superintendent (of the hospital) that she was not well. When they reached the hospital, they were told that she had committed suicide..... Fortunately, the colleagues of the deceased insisted for videography. This suggests that they were suspecting a cover-up," Mehta told the bench

The bench reviewed the status report submitted by the CBI, which had taken over the investigation on the Calcutta High Court's orders, with the records provided by the West Bengal Police.

According to Live Law, after examining the records, CJI DY Chandrachud asked Senior Advocate Kapil Sibal, who was representing the State: "Mr. Sibal, something is very disturbing. The GD (unnatural death) entry in regard to unnatural death is recorded at 10.10 in the morning. So the Police Station is informed that there is an unnatural death. Notwithstanding all this, the securing of the crime scene, seizure etc. takes place at 11.30 at night? What was happening all by then?"

In reply, Sibal claimed that the information was incorrect and asserted that all proceedings had been videographed. He requested the Court to review the chart prepared by the State, which outlined the timeline of events.

Justice Pardiwala asked about the timings of the post-mortem as per records, to which Sibal replied "6.10 PM to 7.10 PM," Live Law reported. 

Justice Pardiwala then inquired why the UD case was registered at 11:30 PM.  "This is very surprising, post-mortem precedes registration of the UD!," Justice Pardiwala said.

Sibal replied that the FIR was recorded, and the UD case was registered that day morning itself. He stated that the UD case was officially logged at 1:45 PM, which left the court wondering.
