Delhi Chief Minister Arvind Kejriwal on Monday (August 12) moved the Supreme Court for bail in the case brought against him by the Central Bureau of Investigation (CBI), which pertains to the now-abandoned Delhi excise policy. This move follows the recent bail granted to his deputy, Manish Sisodia, in the same case.

Challenging both his arrest and the remand orders, Aam Aadmi Party (AAP) sought bail, contesting the Delhi High Court's August 5 judgment. The high court had ruled that Kejriwal's arrest was neither illegal nor unjustified, citing that the CBI had presented “evidently enough evidence” to support his detention and remand.

On Monday, senior advocate Abhishek Manu Singhvi brought the matter to the attention of Chief Justice of India (CJI) DY Chandrachud, requesting an urgent listing. In response, CJI instructed Singhvi to send an email request for an urgent listing.

In its impugned decision, a bench led by Justice Neena Bansal Krishna of the Delhi High Court stated that the arrest could not be deemed unjustifiable or illegal. The Delhi High Court has yet to deliver its verdict on the bail plea submitted by the AAP leader concerning the CBI case, having reserved its decision on July 29. On the same day, the CBI filed its charge sheet against the AAP leader and other accused before a special court.

Kejriwal has been in custody since March 21 following his arrest by the Enforcement Directorate (ED), except for a 21-day interim bail granted by the Supreme Court in May for Lok Sabha election campaigning. 

On July 12, the Supreme Court granted him interim bail in the ED case, recognizing that he had already been detained for over 90 days. However, he remained in custody due to his subsequent arrest by the CBI on June 26 in connection with the same matter.

The case against the chief minister arises from allegations of irregularities in Delhi’s now-abandoned excise policy for 2021-22. The CBI initiated its investigation after a recommendation from Delhi’s lieutenant governor in July 2022.
